can you please advise as to what are the consequences /losses to the defendants for their advocate not filing vakaltnama since last many years and the gains to me the plaintiff.
secondly, A third party advocate has been appearing on their behalf pretending as their advocate without any wakalatnama. the reasons are that the defendantd hands are not clean and the suit is of high merit in favour of the Plaintiff.
I object to their advocates filing Vakaltnama at this point of time.
At present what stand I should take for speedy justice and reliefs.
Should I go to Bar ?

A lawyer can file Vakalatnama/ Power of Attorney (POA) only if he has been appointed by the client and the POA is duly signed by the client.
How can you stop a person to appoint his lawyer when you want to have him in lis with you?
If there was such kind of ambiguity for the last couple of years then you should have objected to this at the initial stage itself.
Otherwise you may approach HC for making your case time bound in case there is an unexplained delay in the disposal of the matter.

Many army people submit this type of qurries, may be he is same person putting it again and again.Making complaints against any body else than himself.
Dear sir pl remember other party has also rights. And just because you think that your case is strong has no meaning , you should be able to prove it under legal system.

If you try to stop defendant's counsel to file his vakaltnama (though you have got no legal right to do so), it shall further delay your case and ultimate sufferer shall be you and not defendant. Seek the opinion of your counsel in this regard. He may better guide you about the rights of the advocates qua filing filing vakalatnama. it can be filed at any stage of the case and even new advocate can be brought on file after conclusion of hearing. You cannot stop him filing his vakalatnama on behalf of defendant.
