does the Complaints Committee constituted under Vishaka Guidelines, has any jurisdiction to recommend an action against the complainant for her alleged misconduct against the complaints committee, if she did not wish to participate in the inquiry as the matter was pending before the court?
Can such complainant be directly dismissed from services without according any opportunity of being heard?

If any matter is pending before the court, for same cause of action, no inquiry shall be conducted without the permission of the court.
Complainant will be a given a chance to prove his innocence.
The overall mechanism of the Complaints Committee is based on the principle of natural justice so that fair and just inquiry is conducted against the delinquent officer.
