Recioal of a sale deed

Querist : Anonymous (Querist) 21 December 2010 This query is : Resolved
Lnd experts,
How important is the recital portion of a sale deed, in deciding the real intention of the parties entering into agreement, especially when the sale deed is more than 40 year old.
Also does recital portion of the sale deed has any importance or not?
Please suggest and guide, if possible with any case law.

With best regards and many many thanks,
Y V Vishweshwar Rao (Expert) 21 December 2010
In a Sale Deed the recital must be that Vendor is the owner , Vendor received /entire sale consideration delivered the possession of the property and transferring/transferred all his ownership /title Rights and indemnity declaration to compensate any losses on account of title Disputes and for any charges and encumbrances . These must be there in a sale Deed -
