propate of a will

My friend's father executed a unregistered will bequothing house property to him and passed away.now my friend wants sto sell the property. Iam of the opinion that the will should be probated(since it is a unregd will)in the court of law.pl.clarify. natarasan

yes you have probate the will after the death of the executor.

The registration act makes it optional to get register the will. and it is better that you will take letter of probation by the civil court.

There is no compulsory letter of probate. the probate is only applies to metros

if probate is not applicable it is better to obtain declaration from civil court on the basis of will.
