Unethical behaviuor.

(Querist) 02 January 2011 This query is : Resolved
A case of mine had gone through district, state consumer forums and a magistrate court. The respondent engaged different lawyers in each court. The respondent had filed his version as counseled by them. But each statement contradicted the other amounting to perjury. Can the lawyers who gave counseling be taken for unethical behavior before bar association where they are enrolled?

Lawyer is not liable.

There is any contradictory stands being taken by the client (certainly not by the Advocate - after all Advocate is only acting as Attorney of the client) you can point out to the court the apparent incongruities in the statements and advance your points. Perjury or non-perjury etc., you have to direct against the client and not the Advocate. If at all anybody who can take action against the Advocate, it is his own client, in case the Advocate has acted contrary to his instructions.

How Can you say that contradictory statements are the result of counselling by lawyers. It may be tne result of counselling by freinds of respondent as is evident by change of lawyer in each case.Probably respondent was not satisfyied with advice of lawyer engaged earlier or lawyer does not agree to plead according to wishes of respondent.

Lawyers are not liable for any contradictions and are not subsequent to face its conseqences. Only and only clients have to face.

Unethical behaviour at all with whom ? with his own client. Then who are you to prosecute ? You do not have any right to lodge complain.
