Sir,

Difference between section 13 & 13B.



I would like to know about the difference in section 13 or 13B or which section is applicable for mutal consent divorce and which section is best for divorce petition.

Kindly help and reply urgently.

Section 13 is Divorce on various grounds for which you have to prove the allegations on which ground you are seeking divorce.

Section 13B-Divorce by mutual ground if both the parties agreed and both should be lived separately for more than a year.

If both are agreed then file u/s 13B.
If another is not agreed go u/s 13.

U/s 13 you have to prove your case as a suit.
