Cancellation of Admission

Last year my Daughter took admission in some college in Mumbai for MBA..
She was then appearing for her graduation exams..and was to submit her grad result by august..
she got compartment in one of her subjects..
The college CANCELLED her admission on the grounds for not submitting the grad result..
But anything of that sort was not mentioned in the prospectus of the college till last year..
I want to take action against the college..
Can I file a case against them?
If so where will I have to file this case..in Delhi(My Current location) or in Mumbai(where the college is situated) ?
Please help..

That will be a futile exercise and waste of money on your part to sue the college, as the minimum eligibility qualification for MBA is Graduation.

In fact it was a concession from the college for asking Grad result only after admission. Admission, if made in the absence of the prescribed qualification is only provisional, which can be canceled on non-fulfillment of the requisite conditions for admission.

The college mentioned that any person APPEARING FOR GRAD EXAMS is also eligible for the admission.
But Cancellation of admission on failure to submit the result was not mentioned in the prospectus.

those who are appearing for the final year exam can apply for the next level of exams (ie.) MBA. It is understood if you are not able to pass the graduation and not able to produce the certificate to that effect, your admission is liable to be canceled.
