Site being occupied by 3rd parties

Hi Experts,

My friend recently came to know that his deceased father had purchased a site measuring 40*60 in 1998.
That when he visited the place he found out that they were squatters on the site claiming that they were put in possession by adjacent owner & also that my friends site was acquired for road.

Request advice on how to go about in completing the documentation;
1) We have a sale deed.
2) tax paid receipt for local pachyath.

Now the site come under city corporation limits, but we do not have layout plan since it was a revenue site when sold.

You can file police complaint or you can file suit for declaration of ownership, eviction, injunction and handing over the property to you. Whether the site is under acquisition or not you can approach the area Tashildar, RDO and if any Spl. Tashildar is appointed for acquiring the land then him and get the details. Further you can apply under RTI Act and get the information.

the legal course is civil suit for possession, which is a long and a bit costly affair.

if they are mere squatters then follow the Joota and Danda power...take local police in confidence.


but if there has been some legal acquisition of the property then first check it up with the concerned authorities, in that circumstance the legal course will be better.

my advice may sound a bit odd to you but practically the things are to be done like this only.

if the site is acquired for road and possession is also taken, there is no point in seeking eviction of the present occupant as that right vests with the acquiring body. The proper remedy in such a case is to claim the compensation amount.
