My father has given a piece of land to my brother before our family partition has made.Now the partition is under processing,my father told me I have not include the piece of land to the total asset.except the land only we will make the partition.Is it correct,suppose If I go to court can we get the piece of land for family settlement.pl give me a detail explanation.

You have to indicate where the property is situated.
How did your father got that property (whether self-acquired or otherwise)
If he got it from his father (i.e. your grand father) then whether the property was self-acquired or otherwise in the hands of your grandfather. Whether your father/grand father are alive now. Otherwise when did they pass away?
When you say that your father gave some land to your brother, how did he give it? Whether through some document and what is that document Gift Deed or else?
What is the composition of your father's family - how many children - sons/daughter etc. etc.

The property has purchased by my father and handed over to my brother with pacca documents.our grandfather was expired.my father is alive.Apart from the Indian law what is the HUF given norms for this type of dispute.

Now, come to the ancestral property. You have not indicated any information which was asked for.

(1) Whether the property was self-acquired or otherwise in the hands of your grandfather.
(2) Whether your grand father is alive now. Otherwise when did your grand father die?
(3) What is the composition of your father's family - how many children - sons/daughter he has?
