Dear sir I got a marriage on 22/2/2011 according the Hindu marriage act & my wife told me on the first night ," if you touch me body or bound me 4 ph. relation I will commit the suicide or cut my hand" after that she agreed for the relation but her behavior was not so good she was flowing her mother on the 14/4/2011 went her prenatal home still not come back & file the bogus case like section 498, dowry case and other cases against me but before all this I have file the section 9 case. So my question this case (section 9) would be defend me & my family if not so guide me how to save myself ?
thanks for every one please clear one more think my wife filed the maintenance case under section 24/125 if the RCR take back by me the maintenance will be continue or not & she is equally educated me. can she essilly take the divorce if yes so how many days/years will be.............

what cases she has filed and for what many cases means what ????????????? and if you have applied for RCR then you are saved and it would defend to that extent that you have really not done or committed any crime like demanding dowry or physical harassment or any other things

RCR is not safety wall reaching to the conclusion that no demand of dowry was made or no harassment was made to wife. Filing of RCR by husband prior to litigation of wife can be treated only a good gesture on the part of husband but no other conclusion can be arrived out of this petition. In your case, it is better if you both directly or with the help of some relative try to negotiate and come to a mutually agreed settlement.

i agree with opinion expressed by Mr.raj kumar makkad that filling a RCR case by husband can, at best, be seen as a good gesture but not a conclusive answer to a wife's case u/s498 or any other.

I do agree with Raj kumar makkad sir. It is not conclusive defense against 498A.

See you are charged of 498 may be real or false, misused by the woman sometimes, and if you go for RCR, definately, it will be a afterthought.

Mr.Patil! RCR by husband was filed before wife's 498" as he says ......"& file the bogus case like section 498, dowry case and other cases against me but before all this I have file the section 9 case. "

RCR may be defend all the co-accused but it is not to proper evidence to save the principal accused.

Equal education only not good grounds for avoid to maintenance. If she don't have sufficient money for maintain her self mean as a husband you have to maintain her. Thats your duty.
