This query is : Resolved
My fathers were three brothers.
They inherited a property from their father i.e. my grandfather
My father had a share in aforesaid property
My father died in 2006
After his death I came to know that my brother has entered into a family settlement with my uncles without tking my consent and without putting this into my knowledge. They got the family settlement registered in 2007.
when later I came to know about it somehow I acquired a copy of the settlement. In the settlement there was a reference of a will reportedly made by father before his death in 2006 in his sons,(i.e. my only brother's) name.
Copy of this will was never shown to me nor I was ever told about this.
Do I have a share in aforesaid property Copy of this

the above said property inherited from grand father to your father so your all legal heirs have rights to share, so you send the notice and cancel the settlement agreement and file a case against them, before you must enter into major.

Your father had no right to transfer the property in your brother's name thru., will because it is ancestral property. File a suit for partition and seperate possession you will get your share.

As the said property is belong as "Ancestral Property" so, u all grand son/ daughter or Grand children are having equal right or in the ratio as declared by your Grand father. at last, u can file cancellation of that settlements.

As per your statement its clear that you and your brother both are alone legal heirs of your father. So you and your father both as entitled to claim half of the share over your father's share. The will is null and void. You can challenge the will and subsequent settlement.

I agree with the expert you acn claim half of the share in property. The will is not valid and has no force.
