Land ownership case...

Dear Experts,

Please advise me.We have a plot in the one city of Haryana. Plot is registered with My father and Brother. The mutation and registration in MC is also with their names. Now Their is one person who is saying that he is also owner of the same property. He is having the Registry of same plot.Except the property he is not having any proof of his ownership. You are requested to help me out that who will be the actual owner of the property.

How your father and brother got that property? If wide a registered sale deed mean just check it, that your vendor was rightful person to sale that property? Also catch the property's mutation chain.. If your side is genuine mean issue legal notice to him.. Also you can file a suit for declaration along with permanent injunction against him.

On the other hand the other side's documents only genuine mean you have to proceed accordance of law against your vendor. I mean he is liable for criminal consequences..

Dear Sir,

my vendor is rightful person, Actually he had saled the some part from one acres. People who have buy the land from vendor don't have maps.

As per mutation chain..property directly come to us from owner of that land bank.

If you sure that your side is genuine mean, just file a suit against him, prayer should be as advised above..

maintain your possession over that land, file a civil suit with a map, get appointed a local commission to see the site and obtain stay order against the opposite party without mentioning his documents or claim of ownership. Let him come before court with complete details. If you continuously maintain your possession over the mentioned site and if your case is properly proceeded, I fully hope in the given facts, none can harm me. You may contact me, if needed as I also do practice in Bhiwani (Haryana).
