Property

Respected sir,
we are having a property which came from our Grandfather.till now we are thinking property is joint property i.e my father and his elder brother,my father brother had died at 34yrs,now his wife and his daughter is taking share till now,my father died in 2005,1month back i had known that entire property is on my father name.
my sister(my father brothers daughter)knows everything about our crops,but i and my brother dnt know as we r doing jobs,my sister is taking more property,i want to know 1 thing
As property is on my fathers name,will my sister will have share in it.will she have a compulsory share in our property,please tell me.

Brothers Sisters and widow (i mean your mother if alive) and Mother(i mean your grand mother,if alive)all have equal share in the property left by your father as per Hindu Succession Act 1956 read with amendment of 2005.
But you have referred about crop that suggest it is agricultural land,if so,law of that state will apply where the land is.Many state follow the succession told but many have enacted their own.

If in UP ,the succession of Agriland shall be governed by UPZA ACT.

If the property belonged to your Grandfather, how come your father became the sole owner?
Check in whose name the land presently stands & act accordingly.

Trace the title. If the property is a JHUF property then every body has a right in it. If the share is separated and handed over to your father then legal heirs of your father has equal share. To avoid complications make a partition deed and take your own share in it clearly.
