Actually every service should be proved with acknowledgement. If that fax connection in the name of your self or your company mean they can serve notice through your fax.. Because after sent fax, he will get a receipt for acknowledgement.

I agree with Mr. Tom.28A(2) CPA READS"(2) The service of notices may be made by delivering or transmitting a copy thereof by registered post acknowledgment due addressed to opposite party against whom complaint is made or to the complainant by speed post or by such courier service as are approved by the District Forum, the State Commission or the National Commission, as the case may be, or by any other means of transmission of documents (including FAX message)."

It seems you have quoted wrong Sec. 28, as Sec. 28 CPA does not relate to service of notice. That relates to "protection of action in good fath by the members of the Consumer Forum".
Sec. 28A relates to service of notice and as per sub-clause (2) of sec. 28A, Fax is a valid mode of transmission. Fax acknowledgment can well serve the purpose of proof of delivery of notice.
