Querist : Anonymous (Querist) 23 September 2011 This query is : Resolved
dear sir,
I have all the documents regarding my ancestral property like mutation, land reciepts, possession etc.now some land brokers have filed a title suit against me by making some forged documents and have also got the suit admitted on the basis of that very forged and manufactured documents. Also they tried for injunction but they were not granted. Now my question is whether i can transfer my suit property in question during the pendency of the suit or should I wait for the disposal of the suit?

As the other party failed to get injunction order, you are free to sale the property under dispute.

SIR, whether i need to file a seperate criminal case for harrassing by making forged and fabricated documents and filing a suit against me or the court will suo motto institute against those persons for producing manipulated documents in the court?
prabhakar singh (Expert) 23 September 2011
Now it is courts right to do so,you could have filed before filing of the suit.
Devajyoti Barman (Expert) 23 September 2011
If the acts of the other party indeed falls under criminal offence, the filing of the criminal case is a definitely good option.

barman sir,
manupulating the public document(in certified copies) and entering one's name is i guess a serious offence and further getting a title suit admitted showing that very manipulated and interpolated document is also an offence again.
Raj Kumar Makkad (Expert) 24 September 2011
Yes. The acts you told are definitely criminal acts. You may bring this to the notice of court in writing and can also sue such person independently.
