Chain agreements

(Querist) 29 September 2011 This query is : Resolved
Last year I purchased flat by one of my known person. He sold me a flat and we made agreement between us. That time I paid money to him by bank. Now after one year I am applying for Loan against property and bank asking for agreement between my seller and builder. I have that agreement number which is mention in recent agreement. I requested to seller about it but he is not able to give cause may be he lost it or he dont have it. Is there any other way to solve this ? as well can he create problems to me in future ?

you can take certify copy from Sub-Registrar office to show bank.

Builder can't give you because lots of other flats land also included in that sale deed.

You require Agreement executed between your seller and his builder. It is very easy to obtain certified copy from builder as agreement is individual and not joint with other allottes.

Agreed with Adv Makked Sb., just apply for its certified copy of the same agreement and submit to the respective bank.

to obtain the copy inspect the date record,if date known,if not inspect year record for all dates, even if year is not known guess the period then apply to inspect for all those years, when get it,then note the details, and with help of those exact details apply for a certify copy.

I paid fees to Sub. reg. office and they are able to give me certified copy. But till bank saying they need original copy of agreement cause agreement between me and seller is recent ( 1 yr ). Also I asked to seller and he said he have the copy but he will not able to give it cause may be need in future. Bank people saying by law he must give me that copy. I just requested to him for it. I think he will give me but till he dont give me then can i take legal action on him ? If yes then how ? ( By FIR or Legal notice )

1. Demand of Bank is genuine.
2. conveyance seller to hand over original sale deed.
3. There is no case of FIR.
