Hi Experts

Could you please let me know

1. what is the stamp duty rate on agriculture land in haryana?

2. How a person can get exemption on stamp duty (Any law or rule)

3. Is it mandatory for Registrar to collect the stamp duty at collector's rate(or can be less than collector rate?

4. is stamp duty rule applies on HUDA sectors in case of realloactment also?

5.How to valuate a House as per govt. rule(Assesment value or total cost for construction) any rule or law?

1.IT IS DECIDED BY THE DISTRICT MAGISTRATE OF EVERY DISTRICT FOR EACH OF THE VILLAGE OF HIS DISTRICT.SO YOU CAN NOW UNDERSTAND HOW CAN ONE SPEAK IN WHICH DISTRICT AND VILLAGE THE LAND IS.????

2.IN FEW STATES SOME REBATE IS AVAILABLE TO LADIES. IN SOME STATE NGOs GET EXEMPTIONS ,SO ITIS A MATTER OF STATE POLICY AND THE POSITION IN THIS REGARD CAN BE ASCERTAINED BY VISITING ANY NEAREST SUB REGISTRAR OFFICE.

3.YES IT IS MANDATORY,MARKET RATE OR COLLECTOR'S RATE WHICHEVER IS GREATER IS THE RULE. PEOPLE HENCE UNDERVALUE THE SALE DEED AND PAY ON COLLECTOR'S FIXED RATE.

5.VALUATION REPORT OF A GOVERNMENT APPROVED VALUER OR SELF VALUATION AGREEABLE TO THE SATISFACTION OF THE SUB REGISTRAR. ASSESSMENT VALUE CAN ALSO WORK IF SHOWN
AND VALUED CONSISTENTLY FOR OVER A PERIOD OF TIME.FOR OLD BUILDINGS DEPRECIATION SHALL BE ALLOWED.

1. Stamp duty rate is fixed in Haryana. It is 5% if buyer is male and 3% in case of female. The rate of land is subject to collector rate.

2. In Haryana, no individual has been given full exemption in stamp duty in case of sale deed of agricultural land.

3. Though registrar has to see stamp duty also but in Haryana auditors have been appointed to look after specially this matter.

Hi

in my 5th question, is there any law or rule when Vigilance team is validating the construction cost
like 750 rs. per sq. feet or other

i am asking this because, i have filed a complaint to Vigilance Dept. against a person for disproportionate assets, he has actually spend 40 lacs on construction of house covered area 5000 sq feet
in that case how vigilance team will validate the cost of construction?

vigilance have power to do so.

Vigilance team can consult the Civil Engineers of PWD or the CPWD, as the case may be, to ascertain the construction cost and can validate the same on certification by that authority. You need not bother on that issue.
