Payment of subsistence allowance

Dear Sir,
I am working as sales promotion employee in a LTD Pharma co.I hv not joined at the transferred place & had applied for PL due to sickness of my wife which has not been approved.Company has setup domestic inquiry which I am attending with my Defence Rep.Co did not suspend me.I hv demanded subsistence allowance.Is it legal?Co is not providing me certified standing order.Is it illegal?No preliminary inquiry was conducted & no show cause notice was sent to me.Both EO & MR are advocates & not the employee of company.Can MR be out sider? pl help.

You are legally entitled for subsistence allowance and Standing orders of company. All these facts shall go in your favour. You can move to court and can seek stay order against your proposed dismissal as their intension is very clear.

Sir,
could you also guide me on following points.
1-Can MR be an outsider Lawyer in domestic inquiry?
2-In which court I can go for stay order?.
3-Inquiry Officer has disallowed 90% of questions as irrelevant & abruptly discharged the MW-1 before lunch break.
4- Mgmt did not give any list of witness & list of documentary evidence as demanded by my DR.
5-After lunch they said that they hv no more witness & asked us to lead the defence which was objected by my DR & fresh date has been fixed.
6- Can I go to Labor court for subsistence allowance & unfair inquiry?
7- Should I attend next date?
