Laptop booking & cancellation

Querist : Anonymous (Querist) 16 October 2011 This query is : Resolved
I have booked a laptop with a reputed company. I have paid 100 money in advance. They promised to deliver within 24 hours at home and had mentioned it in the receipt also.

But, even after 48 hours they have not delivered the laptop. They are also not returning the money. They need some more time for delivery.

In the mean time I found their cost is 2000 more than the another seller.

I need my money enabling me to buy it with the cheap price.

Can I demand for compensation for delay in delivery and refund?
ajay sethi (Expert) 16 October 2011
they promised to deliver you laptop within 24 hours . even if they take 72 hours accept delivery .

if company refuses to refund you will end up spending more than 2,000 in lawyer fees for issue of legal notice .

request them to pay compensation for delay . if they dont agree accept delivery of goods

Legal Delivery System in India is costlier, time and energy consuming and many companies take benefit of fast and effective judicial system. So follow the advice of ajay.

Yes,Mr. Sethi is right.So is Mr.Makkad also.
The matter that now you have an opportunity to buy cheaper can not be a ground.' The axiom or principle in commerce that the buyer alone is responsible for assessing the quality of a purchase before buying called caveat emptor' is still in statute book although consumer protection Act negates it and you can get some damages under the head of agony and anxiety otherwise what loss you can prove on account of delayed delivery .Next when you are so anxious just in 24 hours how much painful it shall become for you when you would see a verdict after having passed several years.
You hurried ,you did also wrong in paying 100% ,you must have doubted on this term alone but you could not visualize, hence have patience now and try to finish the deal peacefully.
Think of court as last resort.
