your elder brother is also having a share in this shop.
Devajyoti Barman (Expert) 11 November 2011
Has your elder brother died?
If yes then the minor son does have a share.

IN ALL PROPERTIES SELF ACQUIRED BY YOUR FATHER ALL THOSE WHO YOU TELL HAVE BEEN LEFT BEHIND ARE HIS HEIRS MINORS OR MAJORS,NO MATTER.

I hope you have understood my advise if not you can revert back only in this thread.

Considering that the property was purchased by your father only. the share would be as follows:

Each of you brothers: 1/5th
Step Mother: 1/5th
Step Sister: 1/5th.

As step sister is minor, his share would be held by your step mother till she turns major.

Look in plain words on the death of a Hindu
dying without a will his heirs who take equally all along are his mother,widow,sons and daughters.

and in addition the following :

son of a pre-deceased son;

daughter of a predeceased son ;

son of a pre-deceased daughter ;

daughter of a pre-deceased daughter;

widow of a pre-deceased son;

son of a predeceased son of a pre-deceased son ;

daughter of a pre- deceased son of a pre-deceased son;

widow of a pre-deceased son of a predeceased son.

And they all take simultaneously.

Hopefully your all confusion in this regard should now get vanished.
M V Gupta (Expert) 13 November 2011
As advised by Shri Prbhakar all of you brothers, step mother and step sister will have equal shares i.e., 1/5th each, in the property which belongs to your garnd father. There is no question of seperate share for any one.
