Sir,
I am working in nationalised bank. I have applied VRS under pension regulation on 08.08.2011, giving three months notice period. Till date I have not received any communication from the competent authority about acceptance of VRS. Also I was on sick leave from 15.08.2011 till 05.08.2011i.e. the entire notice period. I had submitted that I shall submit medical certificate at the time of joining. Today I received a letter from my authority about rejection of sick leave, and that my absence has been treated as unauthorized, but silent about the VRS. They also advise me to report me for duties. Kindly guide me in the matter.

In VRS, no notice is required to be sent. It is up to the management when it issue orders of retirement according to its convenience. The management does not relieve all the volunteers at a time. It has to make proper arrangements to handle the work of the retirees through other employees by making proper adjustments or recruitment.

Acceptance of your desire for VRS is a matter under consideration of the employer. You cannot abruptly be an absentee on the medical ground as you did. It will be fair on your part to join in your duties first and then persue the matter of your VRS.If you can submit authentic proof of your illness your salary cannot be deducted.

About your leave on medical grounds, if you have a valid medical certificate from authorised medical attendant and has submitted in time, your leave cannot be treated as unauthorised absence.
The sentence, "I shall submit medical certificate at the time of joining" indicates clearly that you did not send medical certificate in time. It is not the discretion of the employee to submit the MC any time he desires. Your application for leave must have been accompanied by a formal medical certificate granted by some authorised medical attendant, as prescribed by your organisation. So, the management will not be wrong if that treats your absence as unauthorised absence. You must therefore submit your MC now covering the entire period of your absence and request the management to grant you due leave.
