This query is : Resolved
I filed an FIR regarding forgery of my documents u/s 420/467/468/471 and provided documentary evidences to I.O. But later on I came to know that I.O. did not include my documents in Investigation and rather written in C.D. that applicant did not provide any evidence. Than I complained the matter to higher authorities but before authorities, I.O. refused to receive any document. I again given the documents to I.O. and requested him to give receiving of the documents, but he refused stating there is no such system/ rule or law to give receiving of any document during Investigation. I again fear that he may again not enclose the documents in C.D. to benefit the accused. Now my query is Whether there is any such law / rule that I.O. is not bound to issue any receiving of documents. How I can ensure that my documents are enclosed and considered by I.O. Whether through RTI act I can obtain such information. Whether through court I can file the documents . Or I can legally demand receiving from I.O./ any other police authorities.

The I/O is bound to receive the documents from you and to issue acknowledgement for receiving the document. Take acknowledgement on the xerox copies of each documents.
If he fails to do so, complain it to the DSP/SP. Finally you can approach High Court.

You can send the copies of relevant documents again by way of registered post with copy to higher police officials and can thereafter seek information under RTI Act about the status of your documents and CD.

Instead of giving the documents directly to IO prepare a letter with details of the case attach the documents to it in duplicate and get that stamped at the receiving counter of the concerned police station. The papers would reach the IO from the receiving counter directly and you would also get a stamp and receipt of the police station confirming receipt..
