Double service

Hello,
when one applies 'through proper channel' from one govt deptt(parent deptt) to another govt deptt (new deptt) and
later joins it, thereby he retains a lien in the parent govt deptt for two years.

during these two years he remains at the strength ( on the roll) of 02 govt deptts. WOULD IT NOT TANTAMOUNT TO 'DOUBLE SERVICE' and an ILLEGALITY or otherwise?

Please explain as the matter is disturbing for long.

First of all I wonder, whether you are Amir Haider or Akash, as you write your name as Akash, while you have posted the question with the user ID as Amir Hider?

About your question, you have merely misinterpreted the terms lien and double employment by confusing each other. Lien is nothing but a right to hold a post, as he is confirmed against that post, irrespective of whether he is working on that post or posted to officiate on some other post. On the other hand employment is known against the post where he actually serves to earn salary. In that case he does not draw or earn any salary on the post where he holds a lien.

While the employee is on deputation for two years in some other department/ organisation, he retains his lien in his original department. He does not acquire any lien in the department/ organisation on his deputation post until he is absorbed in that department against any post. While he acquires lien in the other post where transferred, his lien on original post would stand terminated from the date he acquires lien on any other post. A permanent Government employee cannot remain without a lien on any post.

Since you had applied through proper channel and obtained employment in another Dept of the Govt., it will not amount to double/ illegal employment. If your new posting is for a fixed period, you can be repatriated to your original posting Dept.
