sorry for incomplete info from my side.
actually its my first hearing in that case what should i do ?can i get bandra court transferred to thane court before the date 11th jan or i have to attend first date.plz advice

if you are a wife, residing in Thane, it can be trf to Thane . u have to attend on 11th jan .

If you file Transfer petition in the High Court prior to 11th Jan, then you need not appear before the Bandra court.

yes., if you got summon mean without fail you have to appear., in the mean time transfer petition filed before high court and any stay granted mean you need not to appear..

hi
thanx for ur reply
but i am not able to understand when i contacted lawyer why he did not agree to get transferred the case from bandra to thane court.instead when i asked him if we can get it in thane district,he said in that case we have to file from our side and we shouldnt do that.
plz advice

I think the distance between Thane and Bandra is hardly of 50 kms and here in remote area the distance of a village from the district is found more than 100 kms so why to get the case transferred and incur unnecessary money and time for this useless exercise. Defend your case vigorously and effectively.

It takes about 40 minutes from Thane to Kurla and from there 10 minutes in Rickshaw. So contesting the case in Bandra will be better. Further, Bandra court being special family court, the proceedings will be speedy compared to thane court, where the petition will be transfered to a district judge, where there may by number of matters of various Acts.
