I am planning to sell my flat,
1.Is NOC from the society is required to sell the flat? may i have the document that gives the details
2.I have found a buyer who is a Muslim, When i Spoke to my secratary of the society they have mentioned that NOC may not be given for muslims in our society
currently, there is not a single muslim owner in our society, since the builder's time, they have categorically kept muslims out of the society, hence they say that NOC MAY NOT BE GIVEN IF THE BUYER IS A MUSLIM!
i want to know what is the law in regard to this?

no it is not necessary for sale of flat .
if society refuses to transfer flat to a muslim you can file complaint with the Registrar . society cannot discriminate against muslims .

NOC of the society is required in may states prior to sale by registrar. No society can legally discriminate on the basis of caste, creed, sex, region or religion but instead of wasting much time in litigation for this matter, wait for some more valuable customer.

contention of Society is totally illegal and unconstitutional, complain before Registrar of Societies.
