Hi,
I have a property in kerala. When my father passed away the property was divided to my mom, brother and me, Since my brother did not want his share long back it was writtren as 1/2 to me & the other 1/2 to my mom. The tax is paid in both me & mom name. Recently I came to know that my brother forcibly convinced her to write her share to give him. She did not know what was written. I came to know now that it was like giving her share to him. Now she came to know the truth , she wants to give her share to me .The question is
1. can a gift written to someone taken back. Because I read that a gift cannot be taken back.
2. If she wants to rewrite in my name what does she have to do. How can she cancel the old papers.
3.After her death can my brother claim for his share.
4.What is the cost for transfering it into my name & cancelling the old one. & how many days does it take.
I want any lawyers from kerala to answer to these Questions as early as possible. thanks
