Property distribution

(Querist) 15 March 2012 This query is : Resolved
If my father is dead and also grandfather is dead, will the property of my grandfather be distributed equally among the sons, or their can be unequal in distribution of the property in passing it to their son's son.

Firstly your father's share will be ascertained then you will get share in your father's interest..
Raj Kumar Makkad (Expert) 16 March 2012
First of all the property owned by you grandfather shall be distributed equally among his legal heirs means his sons, daughters and wife.

Then come to the share of your father. All the property earned by your father during his life time and left at the time of his death including his share received from his father shall be distributed among his legal heirs means you brothers, sisters and your mother, if alive in equal share.

If your grandmother is alive then she shall also be entitled to inherit equal share with all of you as a legal heir of your father.
