cheque issued but bounced and meanwhile limitation ran out.which sec of lim act will aid plaintiff.

if Cheque date 6 months/ 3 months not expired, deposit cheque once again, and take action within limitation

if limitation has been crossed no need to worry file a compliant along with an application u/s 5 of Limitation Act for condonation of delay.

I have been repeatedly asking the querists to provide the complete details.The date on which the cheque was issued,the value of the cheque,purpose,presentation and the date of the legal notice.

Arun, he mean to lodge compl : u/s 138:
I do not advise delay cond, as time consuming, no summon, no warrant id accused do not accept , + hearing of both sides. Better redeposit cheque if he can

Shri Shroff's advice is right. There is no ban on redeposit of cheque once it is bounced. Fresh objection memo of the bank can of great help.

Again file the chuque with your banker if the same is within limitation.

DO it fast as the validity of DD/cheque is being limited to 3 months w.e.f. 1.4.2012 (presently it is 6 months).
