Accident

(Querist) 08 April 2012 This query is : Resolved 
Dear sir i am a government servant. i made an accident for which the court has given a verdict i.e. amount of 2500/- fine. i have paid the fine and the case is closed now already 6 month has been passed. now on request of opposite party my senior officer are forcing me to give some money to the opposite party as a compensation what should i do? they are harassing me.plz suggest me i will be thank full to you.

you also request your senior officer, you are a servant, and have no money to pay any further.
so do not harass me, get from insurance co.
& i am already penalized 2500/-

Legally you are not liable to pay even a single penny over and above the penalty imposed by Court. If your senior or the complainant harass you then you should file a police complaint against both of them.

Agreed with Ld. Makkad.

Though if you deem that on humanitarian grounds, you should pay something, that is your wish.

Nothing needs to be paid under coercion and you should complain about the same.

No body can compell you to pay compensation to the injured person in an accident case. Because there is the insurer of your vehicle to pay such type of compensation. Advice the aggrieved party to file a MACT case claming compensation before the Member of the motor accident claims tribunal.

If you do not have courage to fight back to the senior officers then pay as directed and better pay even more.



By coming to this forum you show that you intend to fight back.

If you have courage then this action can prove biggest mistake of in career your senior officer.

Take all or any of following steps :-

(i) Submit a complaint to the CVC (if in central Govt or UT service and State Vigilance Bureau in case of State Govt) and copy to the CVO of your department.

(ii) Submit an application the department seeking transfer of your senior officer or yourself on the above ground and none else.

(iii) If you have any staff union the give them written complaint and seek their indulgence.

(iv) Seek an appointment with high of department or higher officer of your boss.

(v) Submit a complaint under Prevention of Corruption Act to the CBI if in central Govt or UT service and State Vigilance Bureau in case of State Govt) requesting criminal action against your boss under Prevention of Corruption Act for misusing his official position. They may not register criminal case on petty matter but can recommend disciplinary action.

If you taken any of the steps then your ACP/APAR cannot be written by said boss or his subordinate.
