IN THE RECENT AMENDEMENT TO DIVORCE LAW AS FAR I COULD UNDERSTAND THE HUSBAND HAS TO GIVE HALF THE SHARE OF HIS RESIDENTIAL PROPERTY WHICH IS ACCQUIRED BY HIM EVEN BEFORE HIS MARRIAGE.
DOES THIS APPLY EVEN IF THE WIFE HAS HER OWN RESEDENTIAL PROPERTY.
Nadeem Qureshi (Expert) 23 May 2012
Dear Ramakrishna

may be not or may be applicable,

It is a proposed amendment, the bill has not yet been passed by the parliament so as to become a law. There may be some changes in mean time till the bill reaches the stage of becoming a law.

In addition to Archanaji,
I do not know why every male is getting panicked,to this amendement? Can anyone answer me whether every 498A or DV Act filed by women are won by them.My answer is no.Every case is won or lost due to merits and demerits. The answer to Mr.Ramakrishna can be answered only by Smt.Jayanthi Natarajan, the Chairman of the Committee.
Ramkrishna (Querist) 24 May 2012
Respected Sainathji,
I have raised this query because I am panicked by the proposed amendment. The query was whether a wife who has her own resedential property is eligible to the proposed amendment.
If this amendment comes into force I feel that the number of divorce cases going up whatever may be the final outcome of the case.
The Family Courts are already overburdened.

I am sorry Mr. Sainathji I have rephrased the query.
I have raised this query because I am not panicked by the proposed amendment. The query was whether a wife who has her own resedential property is eligible to the proposed amendment.
If this amendment comes into force I feel that the number of divorce cases going up whatever may be the final outcome of the case.
The Family Courts are already overburdened
