Dispute

(Querist) 24 May 2012 This query is : Resolved
We were the tenants of a property since last 30 years.I went to get my premises cleaned.

I was shocked to find that my lock had been replaced by another lock by my landlord.

I made a police complaint and I think it appears to be in our favor. But I am doubtful as the premises is still
locked by my Landlord.

Both the parties have been asked to settle.
As in I vacate the place and get as per market value.

If I don't get as per market value.
In this case what do I do?

Regards
Sai

Technically your landlord is in possession of property and hence it makes your case weak, however, with out go into the merits of your case by way of perusal of available documents it is not proper to advise you.

You are not in a possession, but if you have any Rent Receipt or Rent Agreement then you can file a suit for Declaration and Injunction in Civil Court.

I faiuled to understand, ypu kept your 30 years used premises vacant?? Was there no belonging of yours in your tenanted premises. ? Difficult to digest.
If someone changed lock, without yur consent or court order, you can move court, and can get your possession back, if illegal
or do what they did!!

You must not be using the rental premises for long, and you must have suitable alternate accommodation, correct?? If so, settle.

Thank you all for replying.
We are going to settle anyways but what if he doesn't agree on our terms i.e. what if landlord doesn't pay as per market value.
Pl advice.

Sai
