complaint filed with Labour Inspector

(Querist) 21 July 2009 This query is : Resolved 
The contractor has raised construction vide oral agreement but not to satisfaction of owner and raised incomplete construction. Due to which the owner did not pay the total amount now the contractor has filed complaint with Labour Inspector. Is the said complaint is maintainable or not. Pls clarify the same with citation, if any.

labour court is for labour only.
not for contractor.

No. For the contractor only civil suit lies for the recovery of contractual amount. But the contract labour, if they are deprived of their wages, can file a complaint before the labour inspector making contractor and principal employer as respondents.
