Bank a/c without permission

There is a case running between me and my wife under section 9 by me and crpc 125 by my wife for last two and half year. She left my home three years ago. She admitted in her cross that she will not return to the place where I am staying. Wants to buy and stay diff area. Recently she open a a/c in bank on My address where she is not leaving for last three years. My question is can she open bank a/c without my permission on my address. Can I take any legal action against her. Please advice me.

Until she is your wife, she has got a legal right to use her matrimonial address for all purposes and no permission from your side is required for that purpose. You have got no legal right to obstruct her to do so.

Until she is separated legally, she cannot be restrained from using her matrimonial address or to ask for your permission.

Divorce has not happened. It is her marital home.
