Will and witnesses ...

(Querist) 22 July 2012 This query is : Resolved
For a will 2 witnesses are needed -

1.What happens if one witness to the Will expires before the Will is Probated ...
Will this create any kind of problems for the Will to be probated.

2.Should one have 3 witnesses instead of 2 to be more safe.

Thanks ...
Devajyoti Barman (Expert) 22 July 2012
1. Nothing, the other witness would prove. Even on death of both witnesses the Will could be Probated.
2. Not necessary as death of witnesses is no restraint.

So 1 alive witness is enough and one does not needs 2 witnesses ...

Does it creates even little bit of extra effort to prove one witness or no witnesses ...

1.No,it will not create any problems .

2.No.

In case the will is registered the witnesses are not required to prove for its probate otherwise even one of the surviving witness will serve the purpose.
