Co-ownership

(Querist) 10 September 2012 This query is : Resolved
Myself and my husband own a flat (I'm co-owner) worth Rs. 27 lac. I paid 13lac intially out of which I've proof for 6 lac but rest 7 lac was paid by cash. My husband took loan for 14lac where I'm co-obligant.
In sale deed(registered copy) flat amount is kept as 10lac. In sale agreement with builder, its kept as 20lac.
Now our relationship is on verge of separation,my husband says to court that I paid only 6 lac and rest everything by him.
As I'm a co-owner, should I prove the amount which I paid? Also which document court takes into consideration - sale deed(registered copy) or sale agreement(with builder). guide me please.

the things can still be manipulated to get you atleast half share in the said flat.

the court will accept the value of the flat as per the Registered Document only.

and u have a proof that u paid 6 L, thus your share is 60%.

any clever step by your husband may invite tax trouble for him.

should I file a partition suit for this?
