My son did file a divorce case vide No 7/2011 mat suit, divorce case at 2nd AD, Barasat Court, West Bengal, while we reside at Mira Road , Thane (Maharashtra). Subsequently after few months his wife filed a Case under M-29/2011, Bidhannagar court,125 crpc,JM(judicial magistrate), Kolkata ,West Bengal
and then filed 498A/406/34 case no, Lake Town P.S 242/201, Kolkata , West Bengal
In addition her father filed a case No.C-1086, IPC 506/504/34 ,Basirhat Court, ACJM, West Bengal.
The Petitioner in her case No.498A/406/34 case no, Lake Town P.S 242/201, Kolkata , West Bengal, implecated me (father) & my wife (Mother). There after consequent upon filing Charge Sheet by Police , Cognizance taken by Court and vide GR 1135/11 our names were deleted from the case.Untill removal of our name we were subjected to tremendous mental tension and being 70 years of age I became sick and was unable to consentrate in any works. The petitioner has humilated our family while we never lived with her in the same home. While the Petitioner and my son were living at Kolkata , and we were living at Mira Road, Thane, Maharashtra.
Now my query remains as we were subjected to mental torture for nearly one year and to take revenge can I file a case at local court (Thane, Maharashtra)and if so under which section of the law ?
