Family dispute

(Querist) 02 November 2012 This query is : Resolved
Hi,
I am Arun from Ludhiana Punjab. One of my friend age about 50 years served his family including parents and siblings very nicely. He did his best efforts to uplift the family in field of business and society.

From las t couple of years his parents ignoring him in every field and want to separate him. It is also learnt that they have got document namely "Farkhati Nama" registered with local registrar declaring him , his wife and children disowned from family.
Reason behind that he has no male issue and his younger brother having one son. His parents wants to pass on all property ancestrals own earned, jointly earned and family businesses to their male grand child only. Also stating that they will not give a single penny to him. They are also pressurising him and his family to vacate the family house . They are also doing tacts, quarrels and imposing false alligations to alienate him and his family from all assets and properties.

Is somebody can advise me legal opinion on this issue please ?

Thanks.

The documents is illegal.

ancestral property not possible to will to oneperson.

Even the brother owning a son should understand that even he is being by-passed in favour of his son which he will suffer in old age assuch gransons do not look after their paretns.

By the way who is keepjng parents.

The true owner of the property can transfer his right in the property to anybody by executing a Conveyance Deed. However, after his death, in the absence of a ''WILL'' his wealth shall be distributed equally to his legal heirs preferably class-I and otherwise to class-II by the court through issue of a Succession Certificate. An application is to be made to the court for the said purpose.
