Redevelopment query - legal

Hello Sir,
Our building situated in Mumbai Western suburbs is undergoing redevelopment and we have given our consent for the same based on the proposal from the developer
We wanted to buy extra space which was agreed in the society meeting by the developer
We currently have approx 550 sq.ft carpet area
Now in the draft plan our flat is not very well designed and though mutually agreed to buy extra space the developer is just adding more space which is not very useful
We see in the plan that there are two 1 BHK flats which we can buy by paying for the additional area.
We are denied saying that it will have a BMC litigation
Please help me understand if there is really a legal issue

building has to be constructed as per sanctioned plans . if building is not constructed as per said plans BMC wont issue occupation certifcate . you must have engaged a architct . find out whether contention of builder is jsutifed ?

The plan provided to us was from Developer's architect; our society does not have any architect as such
Please suggest
