I am from Karnataka, I had ordered Samsung S5222 star 3 Duos Black on www.kaunsa.com through online netbanking and remitted Rs. 3899 on 20.11.12 and there nothing mentioned on the site that they are dealing with old product. After confirmation I received e-mail that they would deliver the mobile on 05.12.12 but after passing the due date given by them I had not received the product. Therefore I regularly phoned to www.kaunsa.com customer care number and they usually told me that the above product is out of stock so that it might be delayed 2-3 days. When the given time completed I again telephoned them and written complained to their website but they have not satisfactory responded. Meanwhile I demanded to cancel my order on 09.12.12 and asked them to credit my money in my account but I received e-mail on 14.12.12 that we would like to inform you that your order was sent to vendor for dispatching at this stage we could not be able to cancel your order,which you can receive in 2-3 days but I received this product on 22.12.12 which was booked on 20.12.12 through DTDC courier, after calling them so many times an but they send old recycled mobile. This is breach of trust . They have written on the website “The Courts at Gautam Budh Nagar (NOIDA) shall have exclusive jurisdiction in any proceedings arising out of this agreement”. They have cheated me. Please guide where and how to take action against this type of fraud in consumer court . Can I register FIR in Karnataka against this company which is situated in UP.

In cheating case you case file criminal case at the place where you received inducement and acted n inducement.

You should contact the office of SSP of your area wherein a White Coloured Cell is working and lodge your complaint.
