land acquisition 4(1) notification 1978. subsequent govt decides not to proceed with acquisition. a GO passed in 1982 that no acquisition of the same. but this GO kept secret. total extent of land brought under acquisition was around 100 acres. subsequently as the said purpose was dropped the lands were re conveyed excepting a small piece of land around an acre. several people claimed. matter went to supreme court. in 2011 the SC allowed the respective body to re convey the said land to interested person as and when the govt dept wish. note that the 1982 GO was not brought to the knowledge of SC. inquiry held by DRO revenue dept. order passed by DRO revenue dept recommending re conveyance to a particular person who was not at all a party and never ever claimed the said property. clearly vested interest exits with the officials. other person take steps to challenge. the govt officials put all sorts of obstacles to the genuine claimant. even the DRO order copy is suppressed. when the respective genuine owner take serious steps the respective dept take a U turn send a communication that they are not proposing to re convey the said land and that they are planing to bring another new project on that small piece of land. what is the legal position of the govt?, whether the stand of the govt is legal?, what is the remedy available for the genuine owner?. another important fact is that the same govt body in 2007 passed order recommending re conveyance of the same property to another fraudulent claimant colluding with him. only publishing gazette notification was pending. at the last final stage fearing serious repercussion the matter was stopped. in the said order also the respective govt body clearly stated that they are not willing to continue with the acquisition of the said land. that they are not willing to retain the said land.
