How to get marriage registered under hindu marriage act

respected experts i am a hindu by birth.i got marriage with a muslim girl in arya samaj mandir by getting that muslim girl converted in hindu religion . i given her name hindu .i applied our marriage for the registration under hindu marriage registration act in the office of sub registrar office in U.P. But office of sub registrar refused to registered this marriage saying that in this case only special marriage act is applicable not hindu marriage act. my query is that when that muslim girl has changed her religion from islam to hindu,than why we could not get our marriage registered under hindu marriage act ? please advice

Dear Rashid
Pre – Process requirements:
Address proof: passport, driving license, gas bill, ration card, voter ID
Application of marriage form filled.
Five photographs of the two of you in size 2B.
Joint photo of bride and room with signatures over such photo
If asked: Copy of wedding card
Process flow (with ideal number of days indicated for each process )
Application for marriage filled in the prescribed form with :
name and address of bridegroom and bride
Signature of bride and bridegroom,
Signature of 3 attesting witnesses present at the time of marriage along with their name and address,
Joint photo of bride and bridegroom with a signature over each photo should be presented to the Registrar of Marriage.
Marriage officer will verify the contents of the application and records.
He will issue a Certificate of Marriage if he is satisfied that the records produced are in accordance with the law.
The registrar/sub-registrar has power according to section 13 of the UP Hindu Marriage registration Rules 1973

Rashid! Your name depicts as if you are a Muslim and not Hindu.
Anyway, if your wife had got converted from Muslim to Hindu and the marriage was performed in Arya Smaj as per Hindu rites and ceremonies then your marriage registration cannot be denied at any cost being both bride and groom being Hindus. Make a written complaint to DM of the area and then serve a legal notice and wait for the responce.

sir we have met ADMF personally .ADMF is special marriage officer. his saying is that this marriage can be registered only under special marriage act not under hindu marriage act .as the girl is not hindu by birth. sir is that officer correct or wrong. what should we do ? i would like to clear my position that however we can also apply our marriage for registration under special marriage act but there are risks as in special marriage act notices are issued to the parents of both boy and girls. the parents of girl are against this marriage. and there is process of months long in special marriage.so you are requested to advice us on how should we get registered our marriage under hindu marriage act.as girl has already changed her religion from islam to hindu.

The officer is wrong. If either of them have converted to Hinduism prior to their marriage then there is no problem to get the marriage registered as per Hindu Marriage Act. Do as already advised to you.
