Threatening case

one of the tenant as lodged a threatening case against us what should we do we tried to solve it amicably but she did not listen what should we do. she says that we are not giving her water whereas the other portion also as the same water connection and we cant stop for one particular portion. the police station has issued a FIR what is our next step. pls advice.

You should cooperate with the IO of police and show him the tap or connection of the water flowing without any hindrance and further that the complaint is just to avoid rent or eviction.

File a rent petition for eviction of your property from such tenants.

If the complaint is registered as an FIR then you should get anticipatory bail to avoid arrest.On the other hand the Police authority has treated the complaint as a General Diary then you need not worry.But if the said tenant would file a complaint case in Magistrate Court then you can defend the case. You can also file a Suit For Eviction of Tenant on reasonable requirement ground in Civil Court.

i went to the police station and lodged a complaint against her and they have informed me that they will send the file to the magistrate whether they can take the case or not what should i do

You should in close contact with the police station and if you find no action then file a private complaint in the court with the help of your lawyer.
