Rebate under central excise

Dear sir,
We are manufacture exporter, we applied rebate under export under rule 18 of central excise rule 2001 and notification 40/2001 and 19/2004 CE.(NT).
we file the rebate claim to the excise department.but they rejected it for time barred.
but they have not give a chance us to explain the thing about the delay. without of that they given show cause notice directly.
and notification 40/2001 not insisting any thing about time limit.
we gone for appeal. appeal is pending.
any one can give suggection. advice. to get the refund from the appeal it self.

those who are need to get benefited they only need follow the rules and limitations/ if the department clearly given condition and limitation on that. Hope any way you have been violated it may be the reason for rejection .Any how personally go and approach the local authority of concern section and find the fact and try if any possibility of get the same.
