Old property document un-registered - what need to be done to sell this property?

Hi

We have property bought by our father in the year 1964 which was UN-registered (sale deed in URDU between the buyer & seller only).

Our father has constructed mulgees in some part of land and municipal tax has been paid on 3 brothers for construction area.

Now we want to dispose this land & building.

What we should do to sell this property without any problem for the buyer in future also ( like they can avail bank loan or construct apartments to sell etc.,).

in the property card is your father name reflected? registrartion has to be done within maximum 8 months . in the present case nearly 50 years have passed . the seller must not be alive now .

Is the sale-deed in Urdu not registered and who are parties to that sale-deed?

Yeah! The purchaser (our father) Padma Raju passed away.

The parties in the sale deed (URDU) are our father and Mr. Reddy (passed away).

No dispute in regard of property or any other litigation.

Only interest to sell the property without any legal problems to current buyer.

Normally if the sale deed is unregistered, the title will not pass. If the purchasers are ready, sell it in 'as is where is condition'. If the purchasers are hesitating to purchase there is no other way except to file a declaratory suit before the local civil court making all interested persons and all concerned as parties. It may be expensive since you have to pay court fee of approximately 1% on market value of the property. By filing the above suit all the irregularities will be cleared.
