Accident insurance claim

If a person meets with an accident and dies,on what criteria the amount of claim is decided?

My friend's son met with a vehicle accident in India and died.He was 24 years old and was working in Bahrain drawing a salary of around Rs. 30000/-.He had come on leave at that time. The lawyer we approached says that the salary drawn in a foreign country will not be considered as a basis for the claim.He also says that since the person is dead the claim amount will be less than if he were handicapped for life.Is this true?

can you suggest how much amount can be claimed in this case?

The criteria is given in the decision of the Supreme court in Sarla Verma & Ors. Vs. Delhi Transport Corp.& ANR. in CIVIL APPEAL NO 3483 OF 2008
