(Querist) 01 June 2013 This query is : Resolved 
a person has self acquired property i.e. house which is registered in his name,he died and had left a widow mother ,wife and a child. now his mother is claiming share in house and she is not ready to give a share to his sons widow. the deceased brother is also claiming a right in the house.. what is the remedy available to the widow..please advice.

The widow, mother and child of the deceased have equal share in the property. The widow can file a suit for partition to claim her share. The brother of the deceased has no right over the property as the class I heirs are alive.
