(Querist) 02 June 2013 This query is : Resolved
I have purchased(registered sale deed) an agriculture land form khatedar kabiz kastkar in rajasthan.this property came to khatedar from virasat.now married daughter of khatedar filed a suit for batwara in SDO court.what remedy I have in the case?
Adv Archana Deshmukh (Expert) 02 June 2013
Prima facie speaking, if it is the ancestral property then, she has a share in it. But still nothing can be concretely adviced about how to defend, without considering the whole facts and documents in such cases bcoz there are many nitty gritty involved. Better you consult a good advocate practicing in civil side with all the papers.

She have to prove her case,
Let her file her Evidence.
For the time being, you deny her claim in your Written Statement.

Join seller as party.

try settlement,

File FIR against the Sellers as they cheated You,

Search out some other lacuna in property and search some other owners who are sleeping up to now. Wake up them.

Hold possession tightly and forcefully.

Engage a 'REALLY GOOD CIVIL LAWYER'.,

There are so many ifs and buts in Hindu Law as well in revenue laws. Use them.,

People afraid of reputation, encourage the sellers not to spoil it for money,

Mortgage the property with bank and obtain a loan.,

you can do so many other things.

You have not purchased land rather have took the possession as the alleged seller is only a khatedar kabij kashtkar means he is is only a tenant who is having a long possession over that land.

Kashtkari doesn't go to daughters so the partition of possession from the side of earlier kashtkar is not maintainable.
