Acquisition of property by the state which is not described in previous site plan

(Querist) 09 June 2013 This query is : Resolved
Hello,
Sir/Madam

I live in the property which was not under any previously proposed plan according to the district town and planning development map of 1984,but 6 neighbors on the left side of my property have a commercial and residential constructions which are coming in the proposed way in making 45 meter road according to the site plan approved by the town and planning office since 1984,now these neighbors having political and financial strength made the turn in the road through any influence u can say via my property which is already in dispute (between husband and wife )in the district civil court since 2000,and the notification under section 4 of land acquisition act came last year to us.now the question arises is that whether during the pendency of civil suit can state acquires the land and if yes what is the remedy for us to overcome this issue????

Better you challenge notf.u/s 4 before HC.you give notice to DA that change is malafide and to help others and it is colourable exercise of power.File objection before acquiring authority.Pending suit in the court has nothing to do with the acquisition proceedings.
