a bank employee has a loan account under loan to staff category. can he file a suit with consumer court if the bank violate the agreement. Whether he come under category of customer?

you will merely antagonise the bank by moving consumer forum . complain to banking ombudsman . state detauiiled facts of the case . what is nature of breach by the bank

You are not giving full facts. No employee who is in active service will initiate going to consumer forum. He can as well settle the issue with his superiors internally. If you are not in active service due to whatever reasons, the bank will not normally care the needs of such employees. After all the bank is manned with persons who always think that helping a person who is not in active service will antagonize the higher authorities. Please come with full facts. I will try to give some solutions.

As an employee, unless you try to get solution to your problem by using departmental channels, you cannot approach the court. Of course, you are not a consumer of your employer. Loan by bank to its employee is just a matter of welfare measure by the employer, so that its employee may not toil for financial help from other costly sources. So, you should not think about approaching a consumer court. If you approach the consumer forum, you would be liable for disciplinary action as per employees conduct rules prescribed by the bank.

Fully agree with the views of experts. Why not explore internal channel and if seniors are not listening, approach through Employees Association. You may approach more higher Authorities through proper channel.

Rightly advised by experts. Though legally you are also a consumer just for loan issue but it is not advised to bring the issue to consumer fora.

you may go through section 2 of the consumer protection act and decide whether the relation is of employee-employer, loanee-loaner or both.
Come here is any doubt is there.
