Stay on arrest or bail

Hi, my brother was asked to report to police station for some investigation. when he reported to PS, SHO asked him that you are involved in an attempt to murder, looting, and other charges with your friends. This is true that he made a joke with his 2 friends that if this man (who is a jweller and and also a friend of these 3 mutual friends)will die what will be our shares. this was just a joke. FYI all of these 3 belongs to very reputable families of town. Police picked other 2 friends and tortured them and they admitted that they did this attack and also involved my brother as well. We are sure that any of them is not involved in this case but they accepted due to police torture. 2 of them have been chalaned and sent to jail while my brother who is cardiac and depression patient is in the hospital for treatment. Police charged all of 3 with section 120b, 387, 411, 420 etc. Can somebody guide us how to rid off this case, can stay be taken on arrest or can get bail without arrest.

contact a local lawyer . what was your brother doing at the time of incident .? has your brother in his statement admitted his involvement in commissioning of the offence ?have the other 2 accused made any application for bail ?

He was at home which is hardly 500 mtrs away from his friend home who was attacked. My bro did not admitted his involvement rather other 2 friends admitted his involvement when they were interrogated. At present my bro is in hospital and under treatment of cardiac specialist, but he is very much scared. FYI, he himself is a Doctor (BAMS)and never saw this type of situation in his life. Please advise if a anticipatory bail or stay can be obtained on his arrest.

AFTER ARRESTING ab IS NOT POSSIBLE BUT YOU CAN FILE A REGULAR BAIL APPLICATION BEFORE COURT.
